AARTO, introduces significant changes to National Traffic Law Enforcement, which demands that companies adapt swiftly. No longer can they rely on local magistrates or third parties to assist in reducing traffic fines.
AARTO eliminates this practice, making it essential for companies to stay informed about the following crucial changes:
- Demerit points will be assigned for specific violations incurred.
- Notices will be delivered through various methods as dictated by the law.
- It becomes mandatory to nominate a driver for camera violations.
- Paying traffic fines becomes compulsory.
- AARTO introduces an early discount settlement for traffic fines; ignoring this offer will see increased fine values. Failure to pay may lead to the suspension of driver's/vehicle license, professional driving permit, etc.
- Proxies will not receive demerit points for company vehicle violations.
- Proxies or responsible managers will be held accountable for driver violations, including reckless driving, driving under the influence, and using unroadworthy vehicles.
- Demerit points will be applied to vehicles if camera violations are not transferred to the responsible driver.
- Companies and drivers will be fined separately for roadworthy issues, with demerit points issued to both the vehicle and the driver.
- Companies will be obligated to initiate an upskilling program to enhance their employee skills, ensuring business continuity.
- Having company policies and procedures in place to enforce driver behavior during working hours is insufficient. Violations occurring during so-called own time could lead to the loss of the vehicle or driver's license, posing the same risk to the company. Valuable employees could be lost due to violations incurred in own time.
- Loading of vehicles now entails a fresh set of penalties, which are attributed to the responsible Company (Operator). This responsibility could fall on either the company (consignor) responsible for loading the goods, the consignee that receives the goods, or even both. Since this pertains to the roadworthiness of the vehicle, fines and demerit points will be imposed on the driver, Operator, consignor, and consignee alike.
- AARTO is backed by a range of legislation, including the Criminal Procedures Act, POPI Act, OHS Act, Basic Conditions of Employment Act, and more. Familiarity with these laws is crucial for safeguarding both Management and employees.
